Chilton Equestrians Terms and Conditions

'We' are Chilton Equestrian, registered address 20 Elm Rd, Romford, Essex, RM7 8HH, UK. Please take a few minutes to read our terms and conditions. When you make a purchase from us you are indicating that you agree to be bound by them. We may at any given time review and update these terms and conditions without notice. It is your responsibility to regularly check the Website to determine if there have been changes to these Terms and Conditions and to review such changes.

Availability & Acceptance

Our acceptance of your order is subject to the availability of the Products you have ordered, placement of an order does not quantify acceptance by us and your order is only deemed as Accepted once your goods have been dispatched to you. If any of the Products you have ordered are unavailable, or should events occur beyond our reasonable control in respect of the availability of the Products, we reserve the right to reject or cancel your order or, at our sole discretion, whereby a refund will be given and you will be notified accordingly. Where possible a suitable alternative for the Products without liability, may be offered if we deem it is suitable or available in which case further payment may be required. However, in such circumstances we shall advise you as soon as reasonably practicable and give you the opportunity to amend your order. Occasionally items shown on our website may be unavailable or out of stock, it can not be assumed that if any item is shown on our website it is available.

Prices

All our prices are quoted in UK Pounds Sterling and exclusive of delivery costs and goods are sold under English law. Prices may be subject to change beyond our control at any given time, but will be updated as soon as possible. Whilst every effort is taken to ensure the accuracy of our prices, occasionally errors may occur. In these circumstances we are not obliged to fulfil any order where a price has mistakenly been shown incorrectly and as stated above an order is not deemed as accepted until your goods are dispatched. Ordering outside the UK Mainland may incur additional postage charges, please contact us for a quote. Please note all prices are inclusive of VAT where applicable.

Delivery

Goods with cleared payment are usually despatched within 3 working days subject to availability. Delivery charges are stated at checkout, Delivery will always be made to the address provided by you. Once goods have been delivered to you or your nominated address, Chilton Equestrian will not be liable for their subsequent loss or damage. If your order has not been received within 5 working days (UK only), please first contact your local Post Office and sorting office as these are the places our undelivered parcels are usually taken, our the appropriate courier. You should also receive a failed delivery card through your letterbox stating time/date the delivery was attempted. Any customer who fails to act on a failed delivery card and the item is subsequently returned to Chilton Equestrian (you usually have 5 working days to act on the failed delivery) will be asked to pay the cost of re-shipping the item back out to them. If you do not receive the parcel or a failed delivery card within 5 working days you should contact Chilton Equestrian by replying to the dispatch email.

Returns Policy

General Returns Summary

We are happy to exchange or refund items not suitable subject to our Returns Policy. On receipt and inspection of your goods (please note: the law states inspection means examine and does not permit you or your horse to wear or use the items) you deem them as unsuitable and wish to return them you must notify us you wish to cancel the sale within 7 days of receipt of your goods either by email or by letter. If these conditions are not adhered to items will be returned back to the sender at the sender's expense. All items must be returned to our premises within 7 days of us issuing you with a returns code and return form, at the sender's expense. We recommend you use a signed for or recorded service.

Chilton Equestrian takes no responsibility for the goods until they are back in our possession. Where an exchange for identical goods at the same price has been sanctioned we reserve the right to charge you our costs for posting the exchange goods back out and always for exchange of sale/clearance ranges (please see notes below if you are purchasing from those ranges).

Where a refund has been sanctioned we will refund correctly returned items, within 28 days of item receipt to Chilton Equestrian, via the same method as payment was made. Items sold under special offer e.g. buy one get one free items, package sets and wholesale items must be returned as a whole, we cannot refund individually when items are sold as part of a set. We would also ask you return any items bought or gifted to you as part of one of our special offers, if you return the purchased item for a refund.

Non-Refundable Items and Costs PLEASE READ BEFORE YOU BUY.

  1. NON REFUNDABLE: Standard or actual postage incurred (whichever is the greater with prices on application) will be deducted from refunds on correctly supplied returns. Where shipping fees are subsidised by Chilton Equestrian, please take this into consideration when your refund is issued. Actual shipping costs will not be refunded. This is particularly relevant when you have received FREE shipping on your initial order i.e.; shipping has been paid in full by Chilton Equestrian
  2. NON REFUNDABLE: Please note that due to PAYPAL costs in making refunds we now deem it necessary to deduct £0.20 from the refund of the cost of your item to cover this charge.
  3. NON REFUNDABLE: Any item returned in less than perfect conditions e.g. Items not in original packaging, creased, marked, dirty, used, tags missing, incomplete or rugs tried on horses resulting in hair on returned rug making it unfit for re-sale.
  4. NON REFUNDABLE: Any item sent back without the correct paper work
  5. NON REFUNDABLE: Special Orders i.e. orders made to individual specifications, design or measurements
  6. NON REFUNDABLE: Undergarments, riding hats, jewellery, horse bits, lotions, potions and powders. (If unsure please email before you buy)
  7. NON REFUNDABLE: customers requesting a return after 7 days of receipt of item.
  8. NON REFUNDABLE: items returned after 7 days

General Notes

Please take care of your items when examining them; it is your legal duty to do so. We cannot make a full refund on any items that are marked, creased, worn or damaged in any way. When trying a rug on your horse, please do so over a cotton sheet, we will not accept any rugs on our premises that have been dirtied (Health and Safe Act 1972) for safety reasons all equine attire is made to break under pressure through incident, bad fit, etc for example; we are not responsible for tears in rugs, tight straps breaking when horse rolls, buckles giving on ill fitting rugs, head collars breaking if horse pulls back are just a few examples of how horse attire can be damaged the list is endless but please use common sense and question how the item has become damaged before you complain the item is at fault. The above also applies for human attire. In the event you force zips/break straps etc, causing damage to items you are in breech of your statutory rights whilst examining an item, so please take reasonable care of the item in your possession, to avoid making it invalid for refund.

If you return an item as damaged and we suspect that you have deliberately tampered with or broken the item and claimed goods were faulty on issue we will take the necessary action to recover losses in court and involve the police to deal with any criminal fraud.

Goods returned under complaint must be clean/dry (Health and Safe Act 1972) and will not be accepted back on our premises without prior consent from Chilton Equestrian. Goods returned under complaint will be examined on return and we may seek further expert advice when needed. This process may take up to 28 days before we can tell you of any outcome. Wear and use of an item prior to the item developing a fault will be taken into consideration when issuing a refund on an item returned under complaint and subsequently if we agree an item is faulty a refund will be made on that basis. If a customer uses an item after fault has appeared under English Law the customer is deemed as accepting the fault. All Returns of any nature must have relevant paperwork mentioned in our general return policy. It is the customer's responsibility returning any goods under complaint back to Chilton Equestrian.

Our size guide is provided as a helping hand and we are more than happy to help and advise you, although we cannot be held responsible for decisions made when choosing a size.

Product Descriptions

Due to the limitations of photography colours of items you receive may differ slightly to those displayed on your monitor. Chilton Equestrian cannot be held responsible for any variations in product specifications implied by our suppliers. If you are in any way dissatisfied with an item you may of course return it. For further information on returns please refer to the Returns Policy.

Cancellation

Any orders cancelled within 14 days may be subject to a 3% charge to cover administration and banking costs.

Data Protection

The Data Protection Act 1998 is designed to protect individuals about whom information is entered and stored on computer and other systems. Accordingly, it lays down strict standards of accuracy, relevance and care of such data including how it may be divulged. Any data about individuals you enter onto our website directly or include in any message to us will be subject to the Act and you are responsible for its accuracy and relevance and must have the authority to disclose it and for us to utilise it for the purposes of any transaction concluded for or by you through this website. If you are in any doubt about any data please feel free to e-mail us with details of the problem first.

In consideration of agreeing to your use of the Website, you acknowledge that the ownership in any intellectual property rights (including, for the avoidance of doubt, copyright) in the Website belongs to Chilton Equestrian. Accordingly, any part of the Website (or its source HTML code) may not be used, transferred, copied or reproduced in whole or in part in any manner other than for the purposes of utilising the Website meaning that you may only display it on your computer screen and print it out on your printer for the sole purpose of viewing its content.

You may only use the trademarks featured in the Website for the purpose of displaying the Website on your computer screen or printing out the Website on your printer in accordance with the clause above.

You may not link the Website to any other website.

We will collate the information which you give to us during the Online Ordering Service. By giving us this information, you consent to our use of it in order to process your order. In addition, we may use this information to identify other goods, services, offers and promotions which we provide which we think might be of interest to you and to contact you in relation to the same.

Free Classified Advertisements

Chilton Equestrian acts as a third party, and allows an area of the website to be used to advertise horses, ponies and other sale items. Chilton Equestrian is not involved in transactions between buyers and sellers and has no control over the accuracy of the listings; therefore we cannot be held responsible for buyers purchasing horses/ponies or goods that are unsuitable for the purpose purchased. Do not assume that the sale, purchase, export or import of any entry is valid and legal simply because it is listed on the Chilton Equestrian website. Chilton Equestrian is in no way responsible for ensuring that buyers and sellers complete a transaction with each other. You accept sole responsibility for the legality of your actions under laws applying to you. It is the advertiser's responsibility that the advert be legal and honest. Chilton Equestrian cannot guarantee the accuracy of the content of any advert placed on the website. Chilton Equestrian does not accept any responsibility for any loss or injury suffered as a consequence of relying on any information, description or photo contained in any advert it publishes. Chilton Equestrian trusts advertisers have permission to use photographs taken by a third party. Chilton Equestrian cannot be held responsible for any issues arising due to copyright protection on photographs. The seller is responsible for gaining any photographers approval prior to forwarding photographs to Chilton Equestrian to use on the website. Chilton Equestrian reserves the right to refuse any advert on its website and accepts adverts at its own discretion with the right to reject any adverts if feels does not comply with the terms and conditions of advertising. Chilton Equestrian does not have to justify its reasoning for the rejection of any adverts. If an advertiser is stopped from advertising on the website, which Chilton Equestrian does not have to justify, they will receive notification via email. It is the advertiser's responsibility to contact Chilton Equestrian when a listing is no longer for sale.

We make no warranties or representations for any of the contents seen and disclaim all such warranties to the fullest extent. This applies to all damages of all kinds including compensation, direct, indirect or consequential damages, loss or damage to property and claims of third parties.
